Terms of Service

1. Acceptance of Terms

By installing and using Panelque (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not install or use the App. These Terms constitute a legally binding agreement between you and the operator of Panelque.

2. Description of Service

Panelque is a Shopify application that provides:

  • Sales analytics and reporting
  • Inventory management across multiple warehouses
  • Cost tracking and profitability calculations
  • Expense management and categorization
  • Product and variant stock level monitoring
  • Shipment delivery tracking

3. Relationship with Shopify

The App is distributed through the Shopify App Store. Your use of the App is also subject to Shopify’s Terms of Service and Privacy Policy. Billing for the App is handled directly by Shopify.

4. Account and Access

To use the App, you must:

  • Have an active Shopify store
  • Install the App through the Shopify App Store
  • Authorize the App to access your store data as required for functionality
  • Maintain the confidentiality of your Shopify account credentials

You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use.

5. Intellectual Property

The App and all related content, features, and functionality are owned by Panelque and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely in connection with your Shopify store for its intended purpose. You may not reverse engineer, decompile, or disassemble any part of the App, or resell, sublicense, or redistribute it without written permission.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you acknowledge the data practices described in our Privacy Policy.

7. Payment and Billing

If you subscribe to a paid plan:

  • Billing is processed through Shopify’s billing system and App fees appear on your Shopify invoice
  • Subscription fees are charged on a recurring basis as specified in your plan
  • You may cancel your subscription at any time by uninstalling the App
  • Refunds are handled in accordance with Shopify’s refund policies
  • We reserve the right to modify pricing with reasonable notice

8. Service Availability and Support

We strive to maintain high availability of the App but do not guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or other operational reasons.

9. Disclaimer and Limitation of Liability

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PANELQUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP, UNAUTHORIZED ACCESS TO YOUR DATA, ERRORS IN THE APP, OR THIRD-PARTY SERVICES.

IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. You may also terminate by uninstalling the App at any time through your Shopify admin.

Upon termination or uninstall, your store data is deleted automatically and immediately. All provisions of these Terms which should survive termination shall survive.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.
